RULES OF THE PROMOTIONAL GAME
For conducting the Promotional Game «Express your Talent and Win Big»

Promotional game is carried out for promotion of the services rendered by Optima Media Group, hereinafter called also the “Organizer”.

1. The Organizer of the Promotional Game:

1. Promotional Game «Express Your Talent and Win Big» (the Promotional Game) will run for 91 Days (from 13th of September until 12th of December 2012). Please check for more details online at http://gottalentnigeria.com
5. Acceptance of Terms of Use
1. All participants warrant that they have read these Terms and Conditions carefully and fully understand same, which details are available for public viewing at http://gottalentnigeria.com
2. By sending an SMS with the keyword “NGT” (each SMS costs NGN 100.00, VAT Inclusive) to the short code 35685 (the Short Code), the participants signal their complete acceptance and full understanding of these Terms and Conditions and agree:
1. to receive SMS communication from the Organizer on their mobile phones relating to the «Express Your Talent and Win Big» Promotional Game;
2. to receive SMS communication/advertising offers from the Organizer.
3. The Organizer reserves the right to cancel or amend the offer and these Terms and Conditions at any time. Any changes will be posted online at http://gottalentnigeria.com
4. In the event of a dispute regarding the Terms and Conditions, conduct, results, and all other matters relating to the Promotional Game, the decision of the Organizer shall be final and no correspondence or discussion shall be entered into.
5. This Agreement will remain in full force and effect while the Organizer provides the Promotional Game (not taking into account temporary suspensions of the game for operational reasons, e.g. for repairs, planned maintenance or upgrades).
6. Participants of the Promotional Game:
1. The following are eligible to participate:
1. Natural persons (other than people employed by the Organizer for the period of the Promotional Game, and also their close relatives and spouses), who are Airtel, Etisalat, Glo or MTN customers during the period of the Promotional Game. If the winner is under 18, then at the delivery date of delivering the prize, the winner’s guardian must appear to collect the prize having his/her ID as well as a certification proving that he/she is the guardian.
2. The Organizer reserves the right to disqualify any entrant if it has reasonable grounds to believe the entrant has breached any provision of the Terms and Conditions.
3. By participating in the Promotional Game, entrants hereby warrant that all information submitted is true, current and complete.
7. Availability and accessibility of information and Opt-out mechanism
1. All the information for the participants of the Promotional Game with regards to the Promotional Game shall be published at http://gottalentnigeria.com
2. The Promotional Game is based on accruing points, and for the subscriber to know the points accrued at any time, he or she is required to send the key word “SCORE” to the short code 38680 that is zero rated (free)
3. Information about the number of points (participations/chances) scored by the participants during the Promotional Game will be sent to the participants through SMS messages  In order to know his/her score, each participant can send a SMS with the keyword “SCORE” to 38680 (free of charge).
4. Each participant can opt out of the Promotional Game and stop receiving any information about the Promotional Game by sending a SMS with the keyword “STOP” to 38680  After the participant chooses to send a new SMS message with the key word “NGT” to the Short Code, he/she will be again considered as a participant in the Promotional Game and be billed for every SMS sent to the trivia shortcode
5. If the Promotional Game is terminated, the Organizer will publish in the official resources of the Promotional Game (on http://gottalentnigeria.com) a message about the termination of the Promotional Game.  
6. Interruption or early termination of the Promotional Game shall not release the Organizer from its obligation to give out already awarded prizes and execute other actions required, except for cases where termination or interruption of the Promotional Game was called by actions or events which are not under the Organizer’s control.
7. The Organizer of the Promotional Game shall not release personal information about participants of the Promotional Game to any third parties unless required to do so by law or in order to comply with Nigerian Government requirements.
8. The Organizer reserves the right not to enter into written negotiations or otherwise contact with the participants of the Promotional Game other than in accordance with the Terms and Conditions or in accordance with the requirements of the current legislation of Nigeria.
8. Regulation of participation in the Promotional Game:
1. To participate in the Promotional Game, the participant must:
1. Send a blank SMS or the keyword NGT to the Short Code 35685; (each SMS costs NGN 100.00, VAT Inclusive)
2. Vote for his/her favorite contestant in the Nigeria’s Got Talent reality show, by sending SMS (with keyword to be communicated through the media during the broadcast of the show) to the short code 33685; (charged at NGN 50.00, VAT Inclusive) and participate in the Promotional Game by answering questions through SMS to the short code 35685; (NGN 100.00, VAT Inclusive)
2. Once the participant enters the Promotional Game he/she will receive a welcome message containing campaign details and a second message with a question and two possible answers under numbered options (one answer is correct and the other wrong). The participant can answer the question by sending an SMS with a number of his/her choice, representing the correct answer () to the Short Code.
3. The cost of each SMS sent to the voting short code 33685 is NGN 50.00, VAT Inclusive and to the trivia Promotional Game short code 35685 is NGN 100.00, VAT Inclusive. All the Mobile Terminating messages (i.e messages sent to participants’ phones) sent to the participants from the server are free of charge for the participants.
4. For each correct answer to the question, the participant will receive points, which are added up during the Promotional Game. Wrong answers give fewer points than the correct answers. The points for each right answer to the question will be added in two modes:
1. Basic Mode: In basic mode, the participant receives 20 points for each correct answer and 10 points for the wrong or invalid answer.
2. Bonus Phases: There will be bonus phases where the participant receives more points than the ones he can receive in the Basic Mode. In all cases these bonus phases will be communicated to the participant via an SMS. These phases can last from half an hour to one day and will be equally accessible to all participants.
9. Place, date, time and order of the prizes
1. The same subscriber’s number (MSISDN) cannot win the same type of prize (daily, weekly) more than once during the period of the Promotional Game.
2. The formation of participants’ records for the whole period of the  Promotional Game will start at 00:00:01 hours on the first day of the Promotional Game and end at 23:59:59 hours on the last day of the Promotional Game.
3. Draws will be conducted at ‘Within the Box Studio’, 1 Bamako Road, Opposite Omole Phase 1, Ikeja  which is being used for the Nigeria’s Got Talent Show, and the draw will be conducted live on air in the presence of personnel from the Nigeria Lottery Regulatory Commission (NLRC) and the audience .
4. Daily prize
1. The daily winner will be determined every day via a draw. The record consists of entry sets corresponding to the total points earned by each participant until that day (23:59:59). During the Promotional Game, each point earned for the answers is assigned to a unique entry/raffle in the database of the participants. For example, 20 points received for the correct answer entitle each participant (represented by his/her MSISDN) to 20 entries; 200 points to 200 entries/raffles for the drawing of the prize. Each draw will determine 1 winner. Each winner will win 200,000 NGN in cash.
2. The winner will be notified by the Organizer via a SMS or phone call to his/her subscriber telephone number. The winner will receive notice within 15 calendar days from the date of the draw. The name and initials, or name of the organization of the winners may be announced by newspaper ads or via SMS to all the participants included in the record.
3. Participants are eligible to win a prize with just 1 SMS and transfer their points from the beginning of the competition for that particular draw.

1. Weekly prize
1. The weekly winner is determined every week via a draw. The record consists of entry sets corresponding to the total points, earned by each participant from the beginning of the week (Monday 00:00:00) till the end of week (Sunday 23:59:59). During the Game, each point earned for the answers is assigned to a unique entry/raffle in the database of the participants. For example, 20 points received for the correct answer will entitle each participant (represented by his/her MSISDN) to 20 entries; 200 points to 200 entries/raffles for the drawing of the prize. Each draw will determine 1 winner. Each winner that day wins 1,000,000 NGN in cash.
2. The winners will be notified by the Organizer via a SMS or phone call to their subscriber numbers. The winners will receive notice within 15 calendar days from the date of the draw. The name and initials, or name of organization of the winner may be announced by newspaper ads or via SMS to all the participants included in the record.
3. The participants are eligible to win prizes with just 1 SMS and can transfer their points from the beginning of the competition for that particular draw.
2. Grand prize
1. The grand winner will be determined after the end of the promotion via a draw. The record consists of entry sets corresponding to the total points, earned by each participant from the start of the game till the last day of the promotion. During the game, each point earned for the answers is assigned to a unique entry/raffle in the database of the participants. For example, 20 points received for the correct answer will entitle each participant (MSISDN) to 20 entries; 200 points to 200 entries/raffles for the drawing of the prize. The draw will determine 1 winner that will win the grand prize of 5,000,000 NGN in cash.
2. The grand winner will be notified by the Organizer via a SMS or phone call to his/her subscriber number. The winner will receive notice within 15 calendar days from the date of the draw. The name and initials, or name of the organization of the grand winner may be announced by newspaper ads or via SMS to all the participants included in the record.
1. Terms of the prizes:
1. All prizes will be awarded within 90 of the last day of the Promotional Game.
2. The exact date and place of the provision of the prizes shall be published on the official website http://gottalentnigeria.com.
3. The winners are responsible for payment of due taxes and collections for the prizes under any relevant current legislation.
4. The winners will be contacted by the Organizer. The winners must confirm in writing that they are the legal holders of the subscription and that they are entitled to the prize and shall complete all the necessary documents provided by the Organizer. All winners must provide identification documents in order to receive the prize. Prizes may be received by a representative of the winner by proxy upon written confirmation from the winner.
5. By participating in the Promotional Game, the winners agree that any of their data, including names, surnames, photos and video images, can be used by the Organizer for advertising purposes with no prior consent of the winner and free of charge.
6. The Organizer will select up to 5 runner-up winners and if the notified winner refuses the prize or fails to appear to collect it within 10 calendar days of notification, then the Organizer will contact any of the relevant runner-up winners to notify him/her that he/she has won the prize. If none of the runner-up winners accepts the prize or does not show up within 10 calendar days of notification, then the prize will remain the property of the Organizer.
7. Decisions made by the Organizer will be final and no correspondence will be entered into. Prizes are not transferable.
2. Limitation of liability
1. The Organizer accepts no responsibility whatsoever for, including without limitation, any error, omission, interruption, defect, delay in operation or transmission, communications line failure when it is not under its direct control and execution.
2. The Organizer reserves the right to, whenever deemed necessary, temporarily suspend the Promotional Game for operational reasons (e.g. for repairs, planned maintenance or upgrades). The Organizer promises to restore the Promotional Game as soon as possible after any temporary suspension period.
3. The Organizer will deliver the prizes to the winners via bank transfer.
4. The Organizer advises participants to exercise caution and use their discretion in  participating in the Promotional Game at all material times.
3.  Disclaimer of warranties
1. Participants understand and agree that they participate in this Promotional Game at their own risk and willingness and have not been coerced in any manner to enter the Promotional Game.
2. The Organizer makes no warranty, implied or express, that any part of the Promotional Game will be uninterrupted and error-free. 
3. Neither the Organizer nor any of its directors, employees, agents or suppliers shall accept any responsibility for any damage, loss, injury or disappointment suffered by any entrant participating in the promotion or as a result of accepting the prize. 
4. The Organizer is not responsible for any problems or technical malfunction of any telephone network or lines, computer on-line systems, servers, or providers, computer equipment, software failure of any email or entry to be received on account of technical problems or traffic congestion on the Internet, telephone lines or at any web site, or any combination thereof, including any injury or damage to entrant's or any other person's computer or mobile telephone related to or resulting from participation or downloading any materials in the Promotional Game.
5. By entering the Promotional Game, participants agree that no claim relating to such losses or injuries (including special, indirect and consequential losses) shall be asserted against the Organizer, its parent companies, affiliates, directors, officers, employees or agents from any and all losses, damages, rights, claims and actions of any kind resulting from acceptance or use of any prize, including without limitation, personal injuries, death and property damage. 
4. Data protection and Publicity
1. Personal data related to voice, image, name or address and any other relevant information of participants will be included in a filing system belonging to the Organizer as data controller, and can be used for taking part in the competition as well as publicity mailing, or other purposes relating to the Organizer’s services, unless otherwise indicated.
2. Participants agree and consent to the Organizer’s use of such data and the Organizer will use same in a confidential manner.
3. Participants can exercise the rights of access, rectification, deletion and objection to their prior consent for the publishing of their names and pictures on the ‘Nigeria’s Got Talent’ website as well as media where the NGT will be promoted, through a written communication addressed to the Organizer, via e-mail to info@cellcast360.com
4. Participants agree that if they win a prize then their first name and the first [6] digits of their subscriber mobile phone numbers will be published for information purposes only.

1. Governing Law
1. In any case of disagreement arising, participants can present their complaints to the Organizer and the issue will be decided in accordance with the laws of Nigeria.
